I would like to know what firms are doing regarding this. After a client has disengaged, do their material follow the regular retention schedules or do you have a separate schedule for client's your firm no longer represent? And how do you notify the client?

If the client release specifies both active and inactive matters, we'll send them everything.  Usually, though, they only want current materials, in which case that's all we send.

 

We also often copy physical files that are released (per our GC's instructions).  Our standard retention is "10 years after matter closure", and that wouldn't change for these client materials, whether they're originals or copies.  For copies, we'd consider the date of closure to be the date the originals were released.
